Welcome to Aussie Jewellery. These Terms & Conditions apply when you visit our website, use our services or place an order through Aussie Jewellery.

Please read these Terms & Conditions carefully before placing an order. By placing an order through our website, you confirm that you have read and accepted these terms.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded, including rights available under the Australian Consumer Law.

Customer service is available Monday to Friday between 9:00 am and 4:00 pm Central European Time, excluding public holidays.

2. Definitions

In these Terms & Conditions:

Customer, you or your means the person purchasing or attempting to purchase a product through our website.

Aussie Jewellery, we, us or our means the business identified in Article 1.

Product means any jewellery, gift box, message card, accessory or other item offered through our website.

Personalised Product means a product made, engraved, printed, assembled or otherwise customised according to information supplied or selected by the customer.

Order means an order submitted through our website.

Website means the Aussie Jewellery online store and its associated pages.

3. Applicability

These Terms & Conditions apply to:

  • Every offer made through our website
  • Every order placed through our website
  • Every agreement between Aussie Jewellery and the customer
  • The use of our website and its content

Additional conditions may apply to particular promotions, products or services. Where additional conditions apply, they will be displayed with the relevant offer.

Where these Terms & Conditions conflict with mandatory consumer law, the mandatory consumer law will take priority.

4. Products and product information

We make reasonable efforts to ensure that product descriptions, photographs, prices, dimensions, materials and other information are accurate.

However:

  • Colours may appear slightly different depending on your screen and device settings.
  • Handmade, engraved or personalised products may have small natural variations.
  • Product images may include styling items that are not included unless expressly stated.
  • Measurements are approximate unless expressly stated otherwise.
  • Obvious typographical, technical or pricing errors do not bind us.

The product description displayed on the product page explains what is included with the product.

5. Personalised and engraved products

Customers are responsible for carefully reviewing all personalisation information before completing an order.

This includes:

  • Names
  • Initials
  • Dates
  • Messages
  • Symbols
  • Capitalisation
  • Spelling
  • Selected colour
  • Selected size
  • Packaging choices

We will normally produce the personalisation exactly as it is submitted.

Aussie Jewellery is not responsible for errors that were entered or approved by the customer. We may contact you when an instruction is unclear, but we are not required to independently verify names, dates or spelling.

We reserve the right to refuse personalisation containing unlawful, abusive, discriminatory or otherwise inappropriate content.

6. Prices and payment

Prices are displayed in Australian dollars unless another currency is selected or clearly stated.

The final order price will be shown before the customer completes payment. This may include:

  • The product price
  • Selected upgrades
  • Personalisation charges
  • Shipping costs
  • Applicable taxes
  • Discounts

Payment must be completed using one of the payment methods available at checkout.

An order will not normally enter production or processing until payment has been successfully authorised.

We may change product prices at any time. Price changes will not affect orders that have already been accepted and paid for.

7. Shipping charges

We offer free standard shipping on orders over $79 AUD.

Orders below $79 AUD will be charged the applicable shipping fee displayed at checkout.

Express, insured or priority shipping services may carry an additional charge. The available options and prices will be displayed during checkout.

The qualifying order value for free shipping is calculated after discounts and before any shipping charges, unless stated otherwise during a promotion.

8. Order acceptance

After placing an order, you will normally receive an automated order confirmation email.

This email confirms that we have received your order. It does not necessarily mean that the order has been accepted.

We may refuse or cancel an order when:

  • The product is unavailable
  • Payment cannot be authorised
  • The order contains an obvious pricing or technical error
  • We suspect fraudulent or unauthorised activity
  • The personalisation request violates these Terms & Conditions
  • We cannot deliver to the supplied address
  • The order cannot reasonably be fulfilled

When we cancel an order after payment has been received, we will refund the affected amount to the original payment method.

9. Order changes and cancellations

Please contact us immediately at info@aussiejewellery.com when you need to change or cancel an order.

We process and personalise orders quickly. We cannot guarantee that an order can be changed or cancelled after:

  • Production has started
  • Engraving has started
  • Personalisation has been completed
  • The order has been packed
  • The order has been dispatched

Where an order can still be changed, additional costs may apply if the requested change affects the product price or requires the product to be remade.

This section does not limit any rights available to customers under applicable consumer law.

10. Delivery

Orders will be sent to the delivery address provided during checkout.

Customers are responsible for ensuring that the delivery address is complete and correct. Please contact us immediately when you discover an address error.

Delivery dates and timeframes displayed on our website are estimates and are not guaranteed unless expressly stated.

Delivery may be affected by circumstances outside our reasonable control, including:

  • Carrier delays
  • Customs inspections
  • Public holidays
  • Severe weather
  • Incorrect address information
  • Remote delivery locations
  • Local service disruptions

We will make reasonable efforts to assist when a parcel is delayed, lost or damaged.

Customers should review our separate Shipping Policy for additional information about processing, tracking and delivery.

11. Tracking information

When tracking is available, the customer will receive a shipping confirmation containing a tracking link or tracking number.

Tracking information may take some time to become active after the parcel has been handed to the carrier.

The customer is responsible for monitoring the tracking information and arranging collection or redelivery when required by the carrier.

12. Change-of-mind returns

Subject to the exclusions below, customers may request a change-of-mind return within 30 days of receiving the order.

To qualify for a change-of-mind return, the product must be:

  • Unworn
  • Unused
  • Undamaged
  • In its original condition
  • Returned with its original packaging
  • Accompanied by proof of purchase

Customers must contact info@aussiejewellery.com before returning an item.

Unless the product is faulty, damaged or incorrect, the customer is responsible for return shipping costs. Original shipping charges are not normally refundable for a change-of-mind return.

The detailed return procedure is provided in our Return and Refund Policy.

Australian law does not automatically require a business to accept a return solely because a customer changed their mind. However, where a business offers a voluntary change-of-mind policy, it must follow that policy.

13. Personalised-product returns

Personalised, engraved, customised and made-to-order products cannot normally be returned or exchanged because the customer changed their mind.

This includes products created using:

  • A name
  • Initials
  • A date
  • A photograph
  • A personal message
  • A custom symbol
  • A customer-selected engraving

This exclusion does not apply when a product is faulty, damaged, materially different from its description or personalised differently from the information submitted by the customer.

14. Faulty, damaged or incorrect products

Please contact info@aussiejewellery.com as soon as reasonably possible if your order:

  • Arrives damaged
  • Contains the wrong item
  • Contains an error made by us
  • Is faulty
  • Does not match its description

Please provide:

  • Your order number
  • A description of the problem
  • Clear photographs or video showing the issue
  • A photograph of the shipping label where relevant

We may need to assess the product before providing a remedy.

Depending on the circumstances and applicable consumer law, the available remedy may include a repair, replacement, refund or another appropriate solution.

A customer’s rights regarding a faulty product cannot be removed by a “no refunds” policy, a sale price or a time limit stated in a voluntary returns policy.

15. Australian Consumer Law

Our products come with consumer guarantees that may apply under the Australian Consumer Law.

Among other things, products sold to consumers must generally:

  • Be of acceptable quality
  • Be safe and reasonably durable
  • Match their description
  • Be fit for their normal purpose
  • Be fit for a purpose communicated to the seller, where applicable

Where a product has a major failure, the customer may be entitled to choose between a refund and a replacement. Different remedies may apply to minor problems.

These legal rights are in addition to any voluntary returns policy or warranty offered by Aussie Jewellery. They cannot be excluded by these Terms & Conditions.

16. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash
  • Only one discount code may be used per order
  • Discounts cannot be applied retrospectively
  • Promotions are available while stocks last
  • Promotions may exclude certain products
  • A minimum order value may apply
  • Free gifts cannot normally be exchanged for cash

We may end or amend a promotion where there is a genuine technical error, pricing error, misuse or circumstance outside our reasonable control.

Ending a promotion will not normally affect an order that has already been accepted and paid for.

17. Gift packaging and message cards

Gift boxes, message cards, gift bags and other packaging are included only where stated on the relevant product page or selected during checkout.

Packaging may vary slightly from photographs because of availability or product size. Any substitute packaging will be reasonably suitable for the product.

Customers are responsible for reviewing personalised message-card text before submitting an order.

18. Intellectual property

Unless otherwise stated, all content on the Aussie Jewellery website belongs to Aussie Jewellery or is used with permission.

This includes:

  • Product photographs
  • Videos
  • Logos
  • Product designs
  • Message-card designs
  • Engraving designs
  • Written content
  • Graphics
  • Website layouts

Website content may not be copied, reproduced, sold, republished or used commercially without prior written permission.

19. Website availability

We aim to keep the website available and accurate, but we do not guarantee uninterrupted access.

We may temporarily suspend, update or restrict the website for maintenance, security, technical or operational reasons.

We are not responsible for damage caused solely by interruptions outside our reasonable control, except where liability cannot legally be excluded.

20. Limitation of liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

To the maximum extent permitted by law, Aussie Jewellery will not be responsible for indirect or consequential loss that was not reasonably foreseeable when the agreement was formed.

Customers are responsible for following any product care, sizing and safety instructions supplied with a product.

We are not responsible for damage resulting from:

  • Misuse
  • Accidental damage
  • Improper storage
  • Exposure to unsuitable chemicals
  • Failure to follow care instructions
  • Unauthorised alterations or repairs
  • Normal wear and tear

This section does not limit statutory rights relating to product quality, safety or fitness for purpose.

21. Events outside our reasonable control

We will not be responsible for a delay caused by an event outside our reasonable control.

Where such an event materially affects an order, we will make reasonable efforts to:

  • Inform the customer
  • Minimise the delay
  • Offer an appropriate alternative where possible

Where we cannot fulfil an accepted order within a reasonable period, the customer may contact us to discuss cancellation and a refund for the undelivered product.

Please include your order number and a clear explanation of the issue.

We aim to acknowledge and respond to complaints within a reasonable period.

Nothing in this complaints procedure prevents a customer from contacting an applicable consumer-protection organisation or pursuing another legal remedy.

23. Governing law

These Terms & Conditions are governed by the laws of the Netherlands.

However, this choice of law does not exclude or restrict mandatory rights that apply to customers in their country of residence, including rights available to Australian consumers under the Australian Consumer Law.

Disputes may be submitted to a court or authority with jurisdiction under applicable law.

24. Severability

If any part of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

The invalid provision will be interpreted or replaced, where possible, in a way that most closely reflects its original lawful purpose.

25. Changes to these Terms & Conditions

We may update these Terms & Conditions when our business, website, services or legal obligations change.

The version applying to an order is normally the version available when the order is placed.

The most recent update date will be displayed at the top of this page.
